By accessing or using the Be Relevant website and services (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, registered users, and paying subscribers. Be Relevant reserves the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on the Service. Continued use after the effective date of any change constitutes acceptance.

Be Relevant analyzes publicly available job postings to identify the skills employers demand for specific roles. The Service provides:

• Free access to skill demand data across 100+ role categories
• Role-to-role skill comparison tools
• Resume gap analysis for Pro subscribers (comparison of uploaded resume content against live job market data)
• Weekly skill trend reports and email digests

The Service is intended for career research and professional development purposes. It does not guarantee employment or career outcomes.

Browsing skill data does not require an account. To access Pro features, you must create an account and maintain an active subscription.

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 16 years of age to create an account.
• You may not create accounts on behalf of others without their consent.

Notify us immediately at legal@be-relevant.ai if you believe your account has been compromised.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Scrape, crawl, or systematically extract data from the Service using automated tools without our prior written consent
• Attempt to access systems, data, or accounts that you are not authorized to access
• Reverse engineer, decompile, or disassemble any part of the Service
• Upload malicious files, viruses, or any content designed to disrupt or damage the Service
• Resell or sublicense access to the Service without our prior written consent
• Use the Service to build a competing product using our proprietary data or methods
• Misrepresent your identity or affiliation

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

When you upload a resume or other content to the Service, you grant Be Relevant a limited, non-exclusive license to process that content solely to provide the Service to you. We do not claim ownership of your content.

You represent and warrant that you have the right to upload any content you submit, and that such content does not violate any third-party rights or applicable law.

We do not use your resume content to train AI models or share it with third parties, except as described in our Privacy Policy.

The Service, including its design, software, skill taxonomy, data visualizations, and aggregated job market data, is owned by Be Relevant and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

The underlying job posting data is sourced from publicly available listings. We do not claim ownership of individual job postings; our ownership interest is in the aggregation, analysis, and presentation of that data.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Skill demand data is based on a sample of publicly available job postings and may not reflect all market conditions. Career outcomes are not guaranteed.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BE RELEVANT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) $50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Be Relevant and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your account and access to the Service at our discretion if you violate these Terms or if we discontinue the Service, with notice where reasonably practicable.

You may terminate your account at any time by contacting us at legal@be-relevant.ai. Termination does not relieve you of any payment obligations incurred before termination.

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Be Relevant is incorporated, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the dispute is not resolved within 30 days, it shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver: You agree to resolve disputes with us on an individual basis only and waive any right to bring or participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for disputes involving intellectual property or confidentiality.

The Service may contain links to third-party websites or services. These links are provided for convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the privacy policies of any third-party services you access.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where practicable. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
